Overview
These Terms of Service govern your use of Tosona (tosona.ai), a job-application workflow product operated by Tosona.
By creating an account or using Tosona you agree to these terms. If you do not agree, do not use the service. Questions can be sent to support@tosona.ai.
What Tosona provides
Tosona is a tool that helps job seekers create tailored application materials and practice interviews using AI. Features available at any given time are described on tosona.ai and may change.
Your account
You may need to create an account or use a supported sign-in method to access Tosona. You are responsible for maintaining the security of your account and for all activity that occurs under it.
You must be at least 13 years old to use Tosona, or 16 if you are in the European Economic Area or United Kingdom. You may use Tosona only if you are legally permitted to do so and can form a binding agreement with us under applicable law.
Acceptable use
You agree not to:
- Use Tosona for any unlawful purpose.
- Upload content that you do not own or have the right to use.
- Attempt to reverse-engineer, scrape, or extract data from the platform.
- Use automated tools to access the service at scale without permission.
- Use the service in a way that could harm Tosona, other users, or third parties.
AI-generated content
Tosona uses AI to generate application materials and interview practice content. Generated content is a starting point — you are responsible for reviewing and editing it before use.
We make no guarantee that generated content is accurate, complete, or appropriate for any specific application. Tosona does not guarantee any employment outcome.
Subscriptions and billing
Some Tosona features require a paid subscription. By subscribing, you authorize our payment processor to charge your payment method on a recurring basis at the rate shown at checkout.
You may cancel your subscription in accordance with the terms presented at checkout or in your account. Except as required by law, fees are non-refundable.
Intellectual property
You retain ownership of the resume content and job context you upload. By uploading it, you grant Tosona a limited license to use that content solely to provide the service to you.
Tosona's product, software, and brand are owned by us. You may not copy or redistribute them.
Disclaimer of warranties
Tosona is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that outputs will be suitable for any particular purpose.
Tosona is an informational and productivity tool only. It does not provide legal, financial, recruiting, or employment advice, and it does not guarantee interviews, offers, or other outcomes.
Limitation of liability
To the maximum extent permitted by law, Tosona is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including loss of employment opportunity.
Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
Suspension and termination
We may suspend or terminate access to Tosona at any time, with or without notice, if we believe you have violated these terms, created risk for us or others, or if we discontinue the service.
Indemnification
You agree to defend, indemnify, and hold harmless Tosona and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) content you upload or submit; (c) your violation of these terms; or (d) your violation of any rights of a third party.
Copyright and content complaints
If you believe content on Tosona infringes your copyright or other intellectual property rights, please notify us at support@tosona.ai with a description of the claimed infringement and the relevant content.
Governing law and venue
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Subject to the Arbitration and class action waiver section below, any claim arising out of or relating to these terms or Tosona that is not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York, and you and Tosona each consent to the personal jurisdiction of those courts.
Arbitration and class action waiver
Binding individual arbitration. Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these terms or your use of Tosona shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures (or, if JAMS is unavailable, by the American Arbitration Association under its Consumer Arbitration Rules). The arbitration will be conducted in New York County, New York, or by telephone or video conference at your election, and judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
Class action waiver. You and Tosona each waive any right to a jury trial and any right to participate in a class action, class arbitration, or other representative proceeding. If this class-action waiver is found unenforceable, the entire Arbitration and class action waiver section will be void, but the remainder of these terms will remain in force.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Changes to these terms
We may update these terms from time to time. If we make material changes we will update the date at the top of this page. Continued use of Tosona after a change constitutes acceptance of the updated terms.
